1. Applicability of Terms
1.1 These Terms & Conditions (“TOS”) apply to all services provided by ICY SIM, operated by VEROS GROUP LIMITED (“Company,” “we,” “us,” or “our”), including prepaid eSIM sales and related services.
1.2 By using ICY SIM services, including purchasing or activating eSIMs, you agree to comply with these TOS. We may modify these terms at any time, with updates posted on our website. Continued use of our services constitutes acceptance of the updated TOS.
1.3 Definitions:
- End Users: Individuals using ICY SIM eSIM services.
- Business Users: Companies purchasing ICY SIM eSIMs for distribution to their customers.
- End Customers: Individuals receiving eSIMs through a Business User.
- Customer: Any End User, Business User, or End Customer.
2. Services Description
2.1 eSIM Services: ICY SIM resells prepaid eSIMs for mobile connectivity. Customers register to purchase and activate eSIMs via our website or mobile app.
2.2 Registration Requirements:
- End Users: Name, email address, and payment information.
- Business Users: Company name, business address, email, website, phone, and other relevant information required for service delivery.
- End Customers: All information provided by Business Users must comply with applicable data protection laws.
2.3 Service Limitations: We strive to provide quality and reliable service but do not guarantee uninterrupted or error-free service. Customers are responsible for device compatibility with eSIM technology.
3. Charges and Payment
3.1 Payment Methods: ICY SIM accepts:
- Credit/Debit Cards
- PayPal
- Google Pay
- Apple Pay
- Alipay
All payments are processed in USD. Additional processing fees may apply.
3.2 Automatic Renewal (End Users): Services may renew automatically unless canceled. Fees are charged per billing cycle. Cancellations take effect at the end of the current cycle.
3.3 Taxes: All fees include VAT unless stated otherwise. Business Users are responsible for any applicable taxes in their jurisdiction.
3.4 Invoicing: Business Users will receive invoices for all purchases, including eSIMs, top-ups, or services. Invoices are maintained for legal and accounting compliance.
4. Delivery of Services
4.1 Purchased eSIMs are delivered digitally via email and displayed in the user account. Business Users can view purchased eSIMs and packages via their account dashboard.
5. Refund, Cancellation, and Modification Policy
5.1 Refund Eligibility: Customers may request refunds within 30 days if:
- Activation fails, or
- Technical issues arise on ICY SIM’s end after support and troubleshooting.
5.2 Support: ICY SIM provides technical support prior to approving any refund.
5.3 Modifications: eSIM packages are provided as-is. Modifications or customizations after purchase are not permitted.
6. Customer Obligations
6.1 Customers must not use ICY SIM services for illegal, abusive, or fraudulent purposes.
6.2 Device compatibility is the customer’s responsibility. ICY SIM is not liable for device-specific limitations or incompatibility.
6.3 Customers must comply with all applicable laws, including anti-money-laundering regulations.
7. Termination
7.1 End Users: Service agreements end upon deletion of the eSIM or violation of these TOS.
7.2 Business Users: Agreements end upon completion of commitments or deletion of eSIMs. We reserve the right to suspend or terminate accounts that violate these TOS.
8. Limitation of Liability
8.1 ICY SIM is not liable for service interruptions, technical errors, or indirect, incidental, or consequential damages.
8.2 Liability is strictly limited to the amount paid by the customer for the affected service.
9. Intellectual Property
All content, trademarks, logos, and software on ICYSIM.com or associated apps are owned by ICY SIM or licensed to it. Customers are prohibited from copying, distributing, or using our intellectual property without written permission.
10. Governing Law and Jurisdiction
These TOS are governed by the laws of Hong Kong. All disputes arising from ICY SIM services will be subject to the exclusive jurisdiction of Hong Kong courts.
11. Dispute Resolution
Before initiating legal action, customers agree to contact ICY SIM for dispute resolution. We may offer mediation or alternative dispute mechanisms where appropriate.
12. Changes to Services or TOS
ICY SIM may update services, pricing, or features at any time. We reserve the right to revise these TOS, with updated terms posted on our website. Continued use indicates acceptance.
13. Privacy & Data Protection
All personal data is processed in accordance with our Privacy Policy and Cookie Policy. Customers agree to the collection, processing, and use of personal data as described in these documents.
